Process of Escalating a Transaction Dispute

After receiving the runaround by personnel of the University with little to no response, the dispute must be escalated beyond the bounds of the University.

  1.  File a complaint with the Better Business Bureau, recording your statement for the next step.
  2.   Report to the Magistrate Court of Cobb County, located at 32 Waddell Street, Marietta, GA, 30090-9656.
  •   Appear at the Small Claims Division located on the 3rd floor.
  • Fill our two forms with the Registered Agent and Company information.
  • Pay the filing fee of $101.50 (this will be awarded in addition to the amount for which you are suing the school if and when you win the judgment).

Here is what you should know:

  • The school is simply a corporate entity, just like any business that you may visit on a routine basis (i.e., Walmart, Taco Bell, etc.)
  • An invalid charge on your student account is not there to stay no matter what personnel of internal affairs might tell you.
  • Not properly appealing to an unauthorized charge or transaction automatically makes the unauthorized or unwarranted transaction legal.
  • Filing a claim with the Magistrate Court of Marietta brings the matter out of the hands of internal affairs at Southern Polytechnic.

Student Tips

  • Always retain a copy of any contract you ever sign. Do not rely on parents or other personnel to do this for you. Should the validity of a charge be dependent on a term or condition of the contract, it is on you to point this out.
  • Should a hold be placed on your banner web account for an improperly placed charge. You should pay the amount due to the school only; Do not pay a collection agency. If a hold remains due to collection fees; do not pay the fee. Contact Arthur Vaughn (listed Above) to rescind the collection charges pending future judgment. Paying collection fees means you will never get the improperly placed amount back, not even in court. more
Based on others' stories and experiences, here are some possible reasons for an unauthorized charge being placed or not rescinded on a student account.
  • The business office claims that you did not rescind a contract warranting the corresponding charge on the account.
  • Personnel in charge of creating revenue for the University are not meeting quota.
  • Rescinding a charge creates more work for those who must make the necessary adjustments.
  • A member of personnel operating fiscal affairs has a personal vendetta against the student.
  • A member of personnel operating fiscal affairs has no other independent reason for helping the student.
  • A member of personnel in fiscal affairs knows that the student usually gives up after delaying, disregarding, or redirecting the individual for a long enough time.
  • A member of internal affairs feels that amending a questionable charge would set a case precedent for amending questionable charges in the future.
